Section 130.05(2) of the Penal Law of the State of New York clearly states that:
"2. Lack of consent results from:
(a) . . .
(b) . . .
(c) . . .
(d) . . . circumstances under which, at the time of the act of intercourse, . . . the victim clearly expressed that he or she did not consent to engage in such act, and a reasonable person in the actor's situation would have understood such person's words and acts as an expression of lack of consent to such act under all the circumstances."
Well, let's review the facts, shall we? She clearly stated, "not without a condom." Is that a "clear expression" of a lack of consent. Most people would probably agree it is, but hey, if you'd feel comfortable submitting that to a jury, please, feel free to act however you want.
